Frequently Asked Questions

How much will it cost?

Our professional fee is 10% of the total awards amount, covering attorney’s fees only. Filing fees, paperwork, notarization, and other incidental expenses are not included and will be billed separately as they arise, with prior notice whenever possible.

How long will my case take?

The exact duration of your case depends on court schedules, procedures, and other external factors. While we cannot guarantee a timeline, we will make every effort to resolve your case promptly and efficiently, while strictly following legal procedures.

Do I need to attend every hearing?

Your personal appearance is not required at every hearing. You will only need to attend when necessary, and we will provide you with advance notice and guidance should your presence be required.

Will there be any criminal prosecution?

Labor cases in the Philippines are generally administrative or civil in nature and do not usually result in criminal prosecution. However, if the case involves allegations that qualify as criminal offenses under Philippine law—such as falsification of documents, serious misconduct, or other violations of the Revised Penal Code—these may give rise to a separate criminal case. We will evaluate your case carefully and inform you if any criminal liability may apply.

Do you accept cases involving "fit-to-work" assessments?

We handle maritime cases, including those involving fit-to-work assessments. However, such cases are legally and medically complex, which makes outcomes harder to predict. While we are committed to assisting you, please understand that a favorable result cannot be guaranteed due to these challenges.

How does the Magna Carta of Filipino Seafarers affect my case?

Once fully enacted and implemented, the Magna Carta of Filipino Seafarers will strengthen rights related to fair treatment, working conditions, repatriation, medical care, and access to remedies. Its impact on your case will depend on whether the relevant provisions are already enforceable and whether they apply to your specific claims. If applicable, it may provide additional legal support to your case.

Can I still work while my case is ongoing?
Can I still work on board after filing a case?

If your case involves a medical condition, you are considered medically unfit to work until cleared by a doctor. Working may harm your health and negatively affect your case. However, if you can safely perform work-from-home tasks or non-physical duties that do not interfere with your treatment or claims, you may be allowed to continue in that capacity.

Whether you can work on board after filing a case depends on the nature of your complaint, your medical status, and your employer’s policies. If your case involves fitness-to-work or disability issues, re-deployment will not be possible until a competent medical authority declares you fit. Under the Magna Carta of Filipino Seafarers, your health and safety are prioritized. Filing a case does not prevent employment by itself, but legal, medical, and practical considerations must be reviewed before redeployment.
